Leah may be doing the best she can, but in the season premiere of Teen Mom 2 on March 21, her poor kids seemed to be hungry, cold, scared and in danger. Leah is simply not a super-momager like Kris Jenner. But can Leah actually lose custody of her kids simply because she likes to text while driving, as seen in last night’s episode? A West Virginia lawyer says yes.
“If the children are in immediate danger, CPS would get a court order to remove the children from her care,” says attorney Robert B. Kuenzel. “Anybody can contact West Virginia CPS and make a complaint about this bad mother, it does not need to be someone from her immediate family.” Wow, that phone must be ringing off the hook because lots of people saw the season premiere on MTV.

Leah may be getting a visit from a social worker after her wild appearance on the season premiere. “Once CPS receives that report, then they would assign a social worker to go out and investigate the claim right away,” explains Robert.
What should happen if a social worker deems the children to be in danger? “If CPS actually removes the children, the law in West Virginia is that, CPS would look to the closest relative to try and find suitable family placement.”
Leah is not sitting quietly in the face of the bad parenting accusations. Leah found herself in a Twitter feud with fan of the show. “I don’t always text and drive,” Leah defended herself when the fan called out her illegal activity. Well, Leah might have to explain that to social workers if CPS comes knocking. Leah also called her daughter a “drama queen” for wanting breakfast. Wow.
